Terms & Conditions

Please read these terms carefully before instructing CP Plumbing and Heating to carry out any works.

1. Definitions

In these Terms and Conditions:

  • "Company" means CP Plumbing and Heating.
  • "Client" means the person, company, or organisation instructing the Company to carry out Works.
  • "Works" means all plumbing, heating, gas, or related services provided by the Company.
  • "Contract" means the agreement formed when the Client accepts a quotation or allows works to commence.

2. Quotations & Estimates

All quotations are valid for 30 days from the date of issue unless otherwise stated in writing. Quotations are based on information available at the time of inspection. If concealed defects, inaccessible areas, or unforeseen conditions are discovered during the Works, the Company reserves the right to revise the quotation accordingly. The Client will be informed before any additional charges are incurred wherever reasonably practicable.

3. Deposits & Payments

For works valued at £1,000 or more, a deposit of 50% is required prior to commencement. The balance is due upon satisfactory completion of the Works unless otherwise agreed in writing. Invoices for all other works are due within 7 days of completion. Late payments will incur interest at 5% above the Bank of England base rate, calculated daily from the due date until full settlement is received.

4. Access, Working Conditions & Delays

The Client is responsible for ensuring safe, clear, and reasonable access to all areas in which the Works are to be carried out. The Company will not be held liable for delays caused by circumstances beyond its reasonable control, including but not limited to severe weather conditions, supplier delays, unavailability of specialist parts, or actions of third parties.

5. Existing Systems & Disturbance

The Company accepts no responsibility for pre-existing faults, defects, or damage within a property's plumbing or heating systems that become apparent or worsen during the course of the Works. Where any such issue is identified, the Client will be notified promptly, and a separate quotation may be provided to address it.

6. Boiler Installations & Heating Systems

The Company accepts no liability for the failure of existing components within a heating system unless such failure is directly caused by the negligence of the Company's engineers. Where a new boiler is installed into an existing system, the Company strongly recommends a full powerflush prior to installation. Any decision by the Client to proceed without a powerflush is taken entirely at their own risk.

7. Powerflushing & System Cleansing

While every effort is made to improve system performance, the Company cannot guarantee the full restoration of all components following a powerflush or chemical cleanse. Pre-existing weaknesses, such as pinhole leaks or corroded radiators, may become apparent during or after the process. The Company will not be held responsible for such occurrences.

8. Decorations, Flooring & Making Good

Unless specifically stated in the quotation, redecoration, specialist floor finishing, and full reinstatement of disturbed surfaces are excluded from the scope of Works. The Company will make reasonable efforts to minimise disruption and will carry out basic making-good work, but no guarantee is given that surfaces will be returned to their original condition.

9. Parking & Access Costs

Any costs associated with parking, permits, or controlled parking zone charges incurred by the Company's engineers while carrying out the Works will be charged to the Client at cost. Where possible, the Client will be advised of any anticipated parking charges in advance.

10. Customer Supplied Materials

Where the Client supplies materials, fixtures, or fittings for use in the Works, the Company accepts no responsibility for their quality, suitability, or performance. Any additional time or costs incurred as a result of defective or unsuitable client-supplied materials will be charged accordingly.

11. Workmanship Guarantee

The Company provides a 12-month workmanship guarantee on all completed works, and a 24-month workmanship guarantee on full boiler installations and new system installations. This guarantee covers defects arising directly from the Company's workmanship and does not extend to manufacturer defects, misuse, fair wear and tear, third-party interference, or pre-existing faults within the system. All guarantees are subject to the full balance having been settled.

12. Diagnostics & Repair Visits

A diagnostic charge applies to all fault-finding and repair visits. This charge covers the engineer's attendance and an initial period of fault diagnosis. If additional time is required beyond this, it will be charged at the Company's standard hourly rate. The Client will be informed before any further charges are accrued.

13. Health & Safety

The Client is responsible for ensuring that children, vulnerable individuals, and pets are kept away from the work area at all times during the Works. The Company's engineers reserve the right to stop work if they consider the working environment to be unsafe, and will not resume until the safety concern has been resolved.

14. Leasehold & Permissions

Where a property is leasehold, rented, or subject to any landlord, factoring, or management company approval, it is the Client's responsibility to obtain all necessary consents before instructing the Company to proceed with the Works. The Company accepts no liability for any costs arising from the Client's failure to obtain such permissions.

15. Hazardous Materials

The removal, handling, or disposal of hazardous materials (including but not limited to asbestos, lead pipework, or contaminated waste) is excluded from all quotations unless explicitly stated. Where such materials are discovered during the Works, the Company will notify the Client and may need to suspend work until appropriate arrangements are made.

16. Gas Safety & Existing Defects

All gas works are carried out by Gas Safe registered engineers in compliance with current gas safety regulations. Where existing defects, unsafe installations, or non-compliant pipework are identified, the Company is legally obligated to advise the Client and may be required to isolate the supply. Rectification of such defects will be quoted separately and is not included in the original scope of Works.

17. Cancellation Rights

Domestic clients have statutory cancellation rights in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have the right to cancel within 14 days of entering into a contract. If you request that Works commence within the 14-day cancellation period and subsequently cancel, you will be liable for a reasonable proportion of the agreed contract price reflecting the work completed up to that point. Cancellations after the 14-day period may be subject to a cancellation charge to cover materials ordered or preparatory work undertaken.

18. Limitation of Liability

The Company's total liability to the Client in connection with the Works, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total value of the Works as set out in the accepted quotation. The Company shall not be liable for any indirect, consequential, or economic loss. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.

19. Governing Law

These Terms and Conditions are governed by the laws of Scotland. Any disputes arising from the Contract shall be subject to the exclusive jurisdiction of the Scottish courts.

20. Acceptance

Acceptance of a quotation, payment of a deposit, or permission for Works to commence constitutes the Client's full acceptance of these Terms and Conditions. These terms supersede any previous terms and conditions and take precedence over any terms submitted by the Client.
